The coffee board is a statutory authority under the coffee Act, 1942 where the board marketed and distributed coffee. International Coffee Organization which regulates the global coffee export and import of which India was a member. The respondent M/s. Ramesh Exports Pvt. Ltd. was registered with the Board as an exporter. The respondent shipped 230.4 tonnes of without valid ICO certificate of origin. The respondents filed two civil suit seeking damages where decree was passed in favour of respondents and other suit being dismissed. Appeal was preferred but was partly appreciated by the High court of Karnataka.
